1. Scope of Application

The company DeanTrader provides its services exclusively on the basis of these terms of use. At the time of your use of our service, the respective online conditions apply. We do not recognize regulations deviating from these conditions, unless they are confirmed by us in writing. By using the service, you expressly agree to the terms of use.

2. Contents/Offers, Liability

DeanTrader provides its own and third-party information/product offers, algorithms, signals, services and other services (hereinafter referred to as Services). Insofar as these originate from external companies, they are marked accordingly. At the same time, DeanTrader can also make its offers accessible via platforms of third parties (e.g. TradingView). For losses or damages that you may incur by relying on information of these contents/data that you have received in the context of using DeanTrader, DeanTrader is only liable if the damage was caused by intent or gross negligence of the legal representatives or vicarious agents of DeanTrader or if an obligation was violated by slight negligence, the fulfillment of which you particularly rely on (cardinal obligation). In the case of information and product offers of third party companies as well as private persons (e.g. discussion forums) DeanTrader only provides the medium technically. Such content/offers made available to you by third parties are information of the respective creator, author or distributor and not those of DeanTrader. DeanTrader is therefore not responsible for the accuracy or reliability of such content, information and offers under any circumstances. In particular, DeanTrader is not liable for any loss or damage incurred by you as a result of relying on such information. Contributions that are likely to harm third parties or contain pure advertising statements will be deleted by the administrator upon knowledge and in case of a violation of criminal or competition law regulations will be reported immediately. DeanTrader distances itself explicitly from contributions of this kind. The insertion of hyperlinks in our offer is only an access mediation in the sense of § 5(3) Teleservices Act. We therefore do not assume any responsibility for their contents.

Copyrights, property rights and other rights of third parties, which are accessed via DeanTrader, remain fully with the respective rights holder and are protected accordingly. The distribution in any form of the contents and data contained in the Service or on the websites of DeanTrader as well as the implementation of these contents and data on the websites of third parties is not permitted. It is forbidden to use the Services and information listed in DeanTrader for commercial purposes without permission. Misuse will be prosecuted by us. A subscription entitles only during the agreed subscription period to use the Services by one user at a time. For the use by several users a multiple subscription is required, which has to be requested separately. Company licenses are subject to special conditions and forms of offer. The user is obligated to treat access to the Services or channels confidentially. The transfer of the contents of the Services or parts thereof to third parties is prohibited.

4. Conclusion of Contract for offered Goods and Services

For deliveries from the offer of DeanTrader we deliver to the postal address given to us. The resulting shipping costs will be charged at the usual market rates. Place of performance is our delivery warehouse. For deliveries to foreign countries, you will be responsible for the increased shipping costs and, in addition, the additional taxes and customs duties. As far as goods or services are offered by third parties via DeanTrader, any contracts are concluded exclusively between you and the provider of such transactions. Any claims arising from such transactions are directed exclusively against the provider. For all offers, the respective price lists and terms of purchase of the provider apply, which are valid at the time the order is placed.

5. Revocation Instruction

You can cancel your order within 14 days without giving reasons. The revocation period begins from the day on which you or a third party named by you, who is not the carrier, have taken or has taken possession of the first goods.

To exercise your right of withdrawal, you must inform us by means of a clear statement (e.g. letter, e-mail) of your decision to withdraw from this contract. You can use the attached sample withdrawal form for this purpose, which is, however, not mandatory.

Timely dispatch (postmark) is sufficient.

If you revoke the contract, we must refund all payments we have received from you immediately and at the latest within fourteen days from the day on which we received notification of your revocation of this contract. The repayment shall be made to an account disclosed by the customer. In the case of delivered goods, we may refuse repayment until we have received the goods back or until you have provided proof that you have returned the goods, whichever is the earlier.

In the case of delivered goods, you must return or hand over the goods immediately and in any case no later than within fourteen days from the day on which you notify us of the cancellation of your order to the above contact details. The deadline is met if you send the goods before the expiry of the period of fourteen days. You shall bear the costs of returning the goods.

You only have to pay for any loss of value of the goods if this loss of value is due to a handling of the goods which is not necessary for the examination of the condition, properties and functioning of the goods.

6. Period of Notice

The cancellation period for the first subscription is 30 days starting on the begining day of the selected subscription period, otherwise the 14-day period starting from the beginning day of a renewed subscription period applies. The cancellation must be in text form (e.g. letter, e-mail) and should be addressed to:

The timely dispatch of the notice of termination is sufficient to comply with the notice period.

7. Commitments for dialogs

You undertake to limit yourself to the professional exchange of opinions and to refrain from advertising statements as well as to consider the interests of other participants when using dialogue-oriented offers on DeanTrader (e.g. discussion boards). In case of misuse your contributions can be deleted and your membership can be blocked.

8. Access Authorizations

We are entitled to refuse the allocation of user name and password or to terminate the access data with a period of seven days without giving reasons. The right to terminate without notice for good cause, but in particular because of
a) false information during registration
b) misuse of our offer
c) damage or impairment of the functionality of the offer
d) other violations of the general terms of use remains unaffected.

In this case, we expressly reserve the right to assert claims for damages.

9. Accessibility

There is no claim to availability of the website or the various Services at all times. The offer may be temporarily unavailable, in particular due to maintenance work or technical disruptions, without this giving rise to any claims against us.

10. Privacy Policy at DeanTrader

We respect the privacy of our users and undertake to treat the personal data of our customers confidentially. We collect, process and use your data to provide our service, in particular to process orders in our store and to maintain the ongoing customer relationship. This data includes name, address, bank details, company size, industry, position and function. Involved service providers receive your data only to the extent necessary for the performance of our service. We only use temporary cookies and these only in the store to check the status of the shopping cart. In doing so, the cookie is temporarily stored in the user’s RAM. No IP addresses or personal user profiles are stored. We are committed to keeping customer data confidential and expect the same from our cooperation partners.

11. Use of social plugins

This website uses so-called social plugins of the social network Facebook, which is operated by Facebook Inc., 1601 S. California Ave, Palo Alto, CA 94304, USA (“Facebook”). If this agreement provides for the written form, the sending of an e-mail also corresponds to this written form. The law of the Federal Republic of Germany shall apply to all legal relationships arising from the use of the DeanTrader website.

13. Severability Clause

If individual provisions of these general terms and conditions of use are not legally effective in whole or in part or lose their legal effectiveness in whole or in part at a later date, the validity of the remaining general terms and conditions of use shall not be affected thereby. The invalid provision shall be replaced by the statutory provisions. The same applies if the general terms and conditions of use contain any regulatory gaps.

14. Google Analytics

This website uses Google Analytics, a web analytics service provided by Google, Inc. (“Google”). Google Analytics uses “cookies”, which are text files placed on users’ computers, to help the website analyze how users use the site. The information generated by the cookie about the use of this website by users is usually transmitted to a Google server in the USA and stored there.

In the event that IP anonymization is activated on this website, however, Google will truncate the user’s IP address beforehand within member states of the European Union or in other contracting states to the Agreement on the European Economic Area.
